Terms of Service
Please review these terms before using the service. By uploading or using features, you agree to these terms.
1. Service description
Photo Repair provides online photo restoration and enhancement features, including restoration, clarity improvement, denoise, colorization, and detail enhancement. Specific features are subject to what is displayed on the website, and results depend on the quality of your original inputs.
The service provides digital processing outputs only and does not guarantee fitness for any specific use.
Outputs may contain artifacts or deviations, especially for heavily damaged inputs or colorization. You should verify whether outputs fit your needs and keep backups of originals and results.
We may adjust, update, or discontinue features as the product evolves and will provide notice where reasonable.
2. Eligibility and access
You must have full legal capacity to use the service; minors should use the service with guardian consent and guidance.
Some features may require you to provide necessary information or complete verification steps. You must ensure the information you provide is true, accurate, and lawful.
If you create an account or credentials, keep them secure and up to date; you are responsible for risks caused by improper handling. Notify us promptly of any unauthorized access.
3. User obligations (Acceptable Use Policy)
- You must have lawful rights or sufficient authorization for uploaded content.
- Do not upload, submit, request generation of, or attempt to create unlawful, infringing, violent, pornographic, sexually explicit, sexually suggestive, NSFW, fraudulent, or otherwise improper content. This includes, without limitation: nudity intended for sexual context; explicit sexual acts; sexualized or exploitative content; content involving minors in any sexual context; non-consensual sexual content; sexual services solicitation; incest, bestiality, or other illegal sexual content; and attempts to evade moderation through cropping, masking, misspellings, or coded prompts.
- Do not upload sensitive personal data of others without authorization.
- Do not interfere with or disrupt normal operation of the service, including probing, attempting intrusion, or bypassing security measures.
- Do not reverse engineer, scrape, bulk-download, automate at scale, or otherwise abuse service resources.
- You are responsible for complying with applicable laws and regulations in your location.
If we reasonably suspect content or behavior violates these terms (including this Acceptable Use Policy), applicable law, or creates safety or security risks, we may refuse processing requests, block uploads or generated outputs, remove related content, restrict or suspend access, terminate accounts for severe or repeated violations, and preserve relevant records for compliance and abuse prevention. Where required or appropriate, we may report unlawful content to competent authorities.
4. Uploaded content and processing license
To provide the service, you grant us a non-exclusive license to copy, process, transmit, and display your uploaded content within the scope of the service and to generate and deliver outputs to you.
This license is limited to providing the service and does not change your ownership of uploaded content or outputs.
You understand that we may copy, cache, and accelerate delivery of content within a reasonable scope to complete processing.
5. Content and intellectual property
You retain applicable rights to your uploaded content and outputs. We do not claim ownership over your content or results.
The service interface, text, visual design, algorithms, and trademarks are protected by law and may not be copied, adapted, or commercially used without authorization.
6. Fees, subscriptions, and refunds
If paid features are offered, pricing, billing methods, and entitlements will be clearly shown before purchase. You are responsible for confirming payment details and any applicable taxes.
Subscriptions may auto-renew. Renewal cycles and cancellation instructions will be described on the purchase or account page. You are responsible for managing subscriptions before the current period ends.
Unless required by law, completed digital services are generally non-refundable. Promotions or trials are subject to the rules shown on the website.
7. Processing time and storage
Processing time may vary based on file size, network conditions, and system load. We may set limits on file size, format, or frequency to maintain service quality.
Retention and deletion of uploaded content and outputs follow the Privacy Policy. You should download and back up results promptly.
8. Availability
We strive to keep the service available but do not guarantee uninterrupted or error-free operation. Maintenance, upgrades, third-party failures, or force majeure events may cause interruptions.
We will attempt to post advance notice for maintenance or upgrades when feasible. Emergency situations may require immediate action without prior notice.
Some features may be offered as beta or preview capabilities with limited stability or availability.
9. Disclaimer
The service is provided on an “as is” basis without warranties regarding outcomes, fitness, or suitability.
You should assess whether outputs meet your needs and perform human review when necessary.
If the service includes third-party tools, models, or content (including model-provider safety filters and moderation systems), such components may block, restrict, or reject certain inputs or outputs. These safeguards are provided on an "as available" basis, and we do not warrant their accuracy, availability, legality, or completeness, nor guarantee that all unsafe, unlawful, or policy-violating content will be detected or prevented. Your compliance obligations under these Terms remain unchanged.
10. Limitation of liability
To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, or punitive damages arising from use or inability to use the service.
Such damages include, without limitation, loss of profits, revenue, goodwill, data, business interruption, or the cost of substitute services.
We are not responsible for losses caused by network interruptions, device failures, third-party outages, force majeure events, or your own acts or omissions.
If liability is required by law, it will be limited to direct damages that are attributable to us.
In all cases, our total aggregate liability will not exceed the total fees you paid for the relevant service in the 12 months before the event giving rise to the claim (if any). If you paid no fees, our total liability is limited to the minimum extent allowed by law.
Nothing in these terms excludes or limits liability that cannot be excluded or limited under applicable law.
11. Suspension and termination
We may suspend or terminate service if you violate these terms, pose risks, or as required by law.
Where reasonable and feasible, we will explain the reasons for action and provide a chance to appeal or remedy.
During suspension or termination, you may lose access to uploaded content or outputs, so please back up important files promptly.
Termination does not affect payment obligations already incurred or provisions that should survive termination.
12. Third-party services
The service may include third-party links, tools, or infrastructure. Third-party content and actions are their own responsibility, and you must follow their terms.
We do not guarantee the availability, accuracy, or continuity of third-party services, and losses arising from third-party services are borne by the third party or you.
13. Notices
We may send notices via in-product prompts, website announcements, or email. Notices are deemed delivered when sent or posted.
You are responsible for keeping contact details current and reviewing notices. Consequences of invalid contact info or failure to read notices are your responsibility.
14. Privacy policy
Your use of the service is also governed by the Privacy Policy. Please review it to understand how we handle personal data.
If there is a conflict between this Terms and the Privacy Policy regarding personal data, the Privacy Policy prevails.
15. Dispute resolution
If a dispute arises, the parties will first seek to resolve it through good-faith negotiation. If unresolved, either party may submit the dispute to a court with proper jurisdiction.
Before initiating litigation, the parties will make reasonable efforts to resolve the dispute through negotiation.
16. Changes to terms
We may update these terms and publish the latest version on this page. Updated terms take effect upon publication.
If updates materially affect you, we will provide advance notice where reasonable.
